1. Introduction

Welcome to Olympic Saunas! These Terms and Conditions ("Terms") govern your use of our website, olympicsaunas.com, and our services. By accessing or using our website and services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our website or services.

2. Use of Our Website

• Eligibility: You must be at least 21 years old to use our website and services.

• Account Security: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

• Prohibited Activities: You agree not to use our website for any unlawful or prohibited activities, including but not limited to, spamming, hacking, or distributing malware.
   

3. Orders and Payments

• Order Process: All orders and order details must be confirmed in writing or via email.

• Deposit: A 25% non-refundable deposit is required before production begins, and an additional 25% is due once production has started. This secures materials and labor.

• Final Payment: Remaining balance is due at delivery or installation date, unless otherwise agreed in writing.

• Payment Methods: We accept cash, check, credit/debit card, and Zelle.

4.  Cancellations and Refunds

• Cancellations made within 48 hours of paying the deposit may receive a 50% refund of the deposit.

• After 48 hours, deposits are non-refundable.

• Because our products are custom-made, no returns or exchanges are accepted.

5. Lead Time and Changes

• Estimated completion and delivery dates are provided at order confirmation but are not guaranteed.

• Any requested changes must be submitted in writing and may incur additional costs or extend lead times.

• No changes are accepted once production has begun.

6. Delivery and Installation

• Delivery costs will be provided in your invoice. In most cases, placement of the sauna will require special equipment such as a mule or crane, and these costs are the responsibility of the customer.

• The Customer is responsible for preparing a proper site (foundation/pad, level ground, clear access, and any required permits) unless otherwise agreed in writing with Olympic Saunas.

• Olympic Saunas is not responsible for delays caused by site inaccessibility or lack of preparation.

• If on-site construction or assembly is required due to delivery or access limitations, additional costs will apply and will be added to the final invoice.

7. Site Conditions and Permits

• Customers must ensure the installation site complies with local building, zoning, and fire codes unless otherwise agreed in writing with Olympic Saunas.

• Customers are responsible for obtaining any necessary permits, inspections, and approvals unless otherwise agreed in writing with Olympic Saunas.

• Olympic Saunas is not liable for costs or delays resulting from permit issues.

8. Warranty

• We provide a one-year warranty against defects in materials and craftsmanship.

• This warranty excludes damage caused by misuse, neglect, alterations, improper electrical installation, exposure to weather outside intended use, or normal wear and tear.

• Olympic Saunas is not responsible for any interior wood changes or damage resulting from sauna use, including but not limited to splinters, cracks, warping, discoloration, or other effects caused by heat, humidity, temperature changes, or the wet environment inherent to sauna operation.

• Warranty is void if third-party modifications or unapproved repairs are made

9. Natural Wood Disclaimer

• Saunas are built from natural wood, which naturally expands, contracts, and changes over time due to heat, humidity, and temperature differences.

• Variations in color, grain, knots, and texture are normal characteristics of natural wood

• Olympic Saunas is not responsible for splinters, cracks, minor warping, discoloration, resin seepage, or other changes that occur as a result of sauna usage and the wet/hot environment.

• These characteristics are not considered defects and are not covered under warranty.

10. Liability and Safety

• Customer acknowledges that sauna use involves exposure to high heat and accepts all risks associated with its use.

• Customer agrees to follow all usage, maintenance, and safety guidelines provided by Olympic Saunas.

• Olympic Saunas is not responsible for injuries, health issues, or property damage arising from improper use, lack of maintenance, or failure to follow safety instructions.

• Sauna use may pose health risks, including but not limited to dehydration, dizziness, fainting, increased heart rate, or aggravation of existing medical conditions.

• Customers are solely responsible for determining whether sauna use is safe for them. Customers should consult with a physician prior to use, especially if they have heart conditions, high or low blood pressure, respiratory issues, diabetes, pregnancy, or any other medical concerns.

• By purchasing and using a sauna, the Customer accepts all potential risks and agrees that Olympic Saunas is not liable for any health complications, injuries, or consequences that may arise from sauna use.

11. Storage Fees

• Completed orders not accepted for delivery/installation within 10 business days may incur storage fees

12. Late Payments

• Invoices not paid on time are subject to a finance charge of 1.5% per month (18% annually) or the maximum allowed by law.

13. Intellectual Property

• All designs, drawings, renderings, and customizations remain the intellectual property of Olympic Saunas. They may not be reproduced, resold, or shared without written consent.

14. Force Majeure

• We are not responsible for delays or non-performance caused by events beyond our control (e.g., natural disasters, supply chain disruptions, labor shortages, or government restrictions).

15. Dispute Resolution

• In case of dispute, parties agree first to attempt mediation in Washington State.

• If unresolved, disputes will be submitted to binding arbitration under Washington law.

16. Governing Law

• These Terms are governed by the laws of the State of Washington.

17. Release of Liability

• The Customer releases Olympic Saunas from liability for damages, injuries, or losses connected to sauna use, delivery, or installation, except where caused by Company’s gross negligence or intentional misconduct.

19. Changes to These Terms

• We reserve the right to modify these Terms at any time. Any changes will be posted on this page, and the effective date will be updated accordingly. Your continued use of our website and services after any changes constitutes your acceptance of the new Terms.
